Areas of Practice

GUARDIANSHIP

Guardianship is a legal proceeding in which someone (usually a family member) asks the court to find that a person is unable to manage his or her affairs effectively because of a disability. A guardian steps into the shoes of the person with a disability and makes the decisions for them. Mr. Holland can assist in making these applications.

GENERAL DISABILITY LAW

Mr. Holland provides advice and advocacy in a variety of disputes or legal matters involving the disabled, such as seeking residential services from State agencies, such as the Division of Developmental Disabilities (DDD) and the Children’s System of Care (CSOC).

SPECIAL EDUCATION LITIGATION

When parents have a disagreement with a local school district about their children’s special education programming or believe that additional or different programming or even a different placement is required, they have several resolution options, including mediation and due process hearings before Administrative Law Judges. Mr. Holland can provide the legal assistance to handle such litigation.

EDUCATIONAL ADVOCACY / PLANNING FOR THE FUTURE

Avoiding litigation is always a goal for most parents with disabled children. Mr. Holland can provide advice in terms of the handling of meetings to review and revise a child’s Individualized Education Program (IEP) or advocate with local school districts or legal counsel retained by the Board of Education to achieve results that can avoid litigation.
